Terms of Service

These Terms of Service ("Terms") govern your use of mintchillcigars.com (the "Site") and your purchase of products from Mint Chill LLC ("MintChill", "we", "us"). By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

1. You Must Be 21 or Older

The Site sells tobacco products and related merchandise intended solely for adults. By using the Site you certify that you are at least 21 years of age. It is unlawful to purchase tobacco products for anyone under 21, and we will cancel any order we believe involves an underage purchaser.

2. Age Verification

Every order containing age-restricted products is subject to identity and age verification through our third-party verification provider, AgeChecker.net. You agree to provide accurate information and, if requested, a copy of your government-issued ID to complete verification. If verification cannot be completed, your order will be cancelled and you will not be charged (any authorization hold on your card will be released).

3. Orders and Payment

• When you place an order, your payment card is authorized but not yet charged. Your card is charged only after your order passes age verification and is accepted for fulfillment.
• All orders are subject to acceptance. We may cancel any order (for example, for suspected fraud, verification failure, pricing or inventory errors, or shipping restrictions), in which case any hold on your card will be released or your payment refunded in full.
• Prices are in U.S. dollars and may change at any time. Applicable sales tax and shipping charges are calculated and shown before you pay, on the secure payment page.

4. Shipping and Delivery

• We ship only within the United States, and only to states where we are authorized to sell. If your state is not currently served, checkout will tell you.
• Deliveries containing tobacco products require the signature of an adult 21 or older at the delivery address. Carriers will not leave these packages unattended. Please ship to an address where an adult can sign.
• Title and risk of loss pass to you upon delivery. If your package arrives damaged or incorrect, contact us within 7 days of delivery and we will make it right.

5. Cancellations, Returns, and Refunds

• You may cancel an order for a full refund at any time before it ships.
• All tobacco sales are final once shipped. Federal and state law and product-integrity concerns prevent us from accepting returns of tobacco products.
• Non-tobacco merchandise may be returned unused within 30 days of delivery; contact us to arrange a return.
• Damaged, defective, or incorrectly shipped items will be replaced or refunded. Contact us within 7 days of delivery.

6. Compliance and Prohibited Use

• Products are sold for personal consumption only. Resale is prohibited.
• You may not purchase products on behalf of, or for delivery to, anyone under 21.
• You are responsible for complying with the laws of your state and locality. Where we do not collect a tax that your state or locality requires (for example, certain consumer use taxes), you remain responsible for it. This does not apply to sales tax we already calculate and collect at payment.
• You may not use the Site to violate any law, interfere with its operation, or attempt to access accounts or systems that are not yours.

7. Accounts

You are responsible for the accuracy of the information on your account and for safeguarding access to it. We may suspend or close accounts used in violation of these Terms.

8. Health Warning

Cigars and other tobacco products are not safe alternatives to cigarettes. Tobacco smoke contains carbon monoxide and other chemicals known to cause cancer, heart disease, and other serious illness, and nicotine is addictive. Tobacco products should not be used by minors, pregnant or nursing women, or persons with heart conditions or other health concerns.

9. Intellectual Property

The Site and its content, including the MintChill name, logo, product descriptions, images, and the Smoker's Guide, are owned by MintChill or its licensors and may not be copied or used commercially without our written permission.

10. Disclaimers and Limitation of Liability

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, and our total liability arising from your use of the Site or any purchase is limited to the amount you paid for the order giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify and hold Mint Chill LLC harmless from claims arising out of your violation of these Terms, including any purchase made for or transfer of products to a person under 21.

12. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Any dispute shall be brought in the state or federal courts located in North Carolina, and you consent to their jurisdiction.

13. Event Services (Catering)

On-site cigar service for private events is offered under a separate written Event Service Agreement signed by the event host. These Terms govern purchases through the Site; the Event Service Agreement governs the event itself, including any minimum purchase, service fee, and on-site age-verification duties. No cigars are sold at an event. The host purchases any merchandise through the Site, subject to the same age verification and payment terms above.

14. Changes to These Terms

We may update these Terms from time to time; the date at the top reflects the latest revision. Changes apply to orders placed after they take effect. Continued use of the Site constitutes acceptance of the updated Terms.
